General Terms and Conditions
1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts regarding tandem paragliding flights concluded between Fly2 (hereinafter "Provider") and the customer (hereinafter "Passenger"). By booking a tandem flight, the passenger accept these GTC as binding.
2. Services
Fly2 provides the mediation and organization of tandem paragliding flights with professional, state-licensed tandem pilots. The execution of the flight itself is the sole responsibility of the respective pilot.
3. Requirements for Participation
- Body weight: between 20 kg and 110 kg.
- Minimum age: 5 years (under 18 years only with written consent from a legal guardian).
- Health: No health restrictions (e.g., cardiovascular diseases, epilepsy, pregnancy, etc.). The passenger is obliged to provide truthful information regarding their state of health.
4. Weather and Safety Conditions
Tandem flights are weather-dependent. The respective pilot alone decides on the execution, postponement, or cancellation of a flight for safety reasons. In the event of a weather-related cancellation, an alternative date will be offered. A claim for a refund only exists if no alternative date can be arranged.
5. Withdrawal / Cancellation by the Passenger
- Free cancellation up to 24 hours before the appointment.
- Less than 24 hours before the appointment or in case of a no-show: the full deposit/amount is due.
- A substitute person can be named, provided they meet the requirements for participation.
- In the event of a passenger delay of more than 15 minutes relative to the booked flight time, the booking will be cancelled without any entitlement to a refund of the deposit.
6. Withdrawal by the Provider
The provider may cancel a flight due to adverse weather conditions, force majeure, or organizational reasons. An alternative date will be offered. Further claims against the provider are excluded.
If a passenger arrives more than 15 minutes late for their scheduled flight time, the reservation will be canceled and the deposit will not be refunded.
7. Responsibility and Liability
Fly2 acts exclusively as a mediator and organizational provider of tandem flights. The actual flight is carried out legally, professionally, and in terms of liability entirely and independently by the respective pilot. The provider (Fly2) is not liable for damages or accidents occurring during the flight. Responsibility and liability for the flight and the passenger's safety lie solely with the executing pilot – regardless of where or through whom the flight was booked or paid. The passenger acknowledges that:
- the pilot acts independently,
- the flight is undertaken at the passenger's own risk,
- and all decisions regarding the flight path, takeoff, safety, and landing rest with the pilot.
8. Insurance
All deployed tandem pilots hold the legally required aviation liability insurance. Additional accident insurance is not included and is the responsibility of the passenger.
9. Photo and Video Recordings
If photo or video recordings are made during the flight, the passenger agrees to their use for private or promotional purposes by Fly2 - unless expressly objected to.
No charge in case of technical data loss. After the flight, the recordings will be transferred to the customer's smartphone in their original format. If this is not possible, the SD card will be handed over after a joint review; the responsibility for data backup then passes to the customer.
10. Vouchers
Vouchers are valid for 1 year from the date of issue. After expiration, redemption can only take place by arrangement and for a surcharge. Cash refunds are excluded. Redemption is only possible by prior appointment.
Should the passenger arrive more than 15 minutes late relative to the booked flight time, the booking will be cancelled and the voucher will still be redeemed.
11. Jurisdiction and Applicable Law
The law of the Italian Republic applies exclusively. To the extent permitted by law, the place of jurisdiction is the registered office of the provider.
12. Severability Clause
Should any provision of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the intended economic purpose.
